ADU Rescue
Accessory Dwelling Units (ADUs) created without permits should be permitted, including any necessary upgrades as soon as possible, to avoid the risks of unpermitted construction. However, this may not always be feasible right away.
ADU Rescue is a program that allows qualifying owners to ask for an enforcement extension of up to five (5) years on an ADU created without permits. One of the primary goals of this program is to avoid displacing occupants of these ADUs until permits can be aquired, while ensuring they do not present a threat to health and safety. How do I qualify for Enforcement Extension?
Your ADU may be eligible for delayed enforcement if both of the following are true:

It was constructed during one of the following time periods:
- Before October 14, 2021.
- January 1, 2023 - Before January 4, 2024.

January 1, 2025 - Before January 8, 2026.

It is not considered substandard under Section 17920.3 of the Health and Safety Code as determined by a habitability inspection conducted by a person licensed by the California Contractors State License Board or a licensed design professional like an architect or engineer. This inspection must contain, at minimum, a review of the structure for compliance with housing standards pursuant to the California Health and Safety Code, from a licensed professional.

“Why Should I Legalize My Unit?”
- Reduce the risks to the occupants. ADUs that are unpermitted may unknowingly present serious health and safety risks to the occupants.
- Reduce liability. An illegal ADU would pose as a significant liability to the owner. For example, insurance would not cover damages if a fire started in the unit.
- Increase your property value. Improve the potential for both the rental income and/or resale value by legalizing the ADU.
- For your peace of mind. Legalizing your ADU can eliminate any worries about code enforcement actions against you.
